Acceptance of Terms and Conditions of Use
Help Around Town is a communications platform that allows persons seeking services ("Buyers") to find persons willing to meet those needs ("Service Providers") (collectively "Users"). Help Around Town only facilitates the connection of Users and is not a party to any agreement between Users. Users understand that Help Around Town does not control and cannot provide any representations as to the truthfulness, quality, timing, responsibility, or legality of any posting, User information or actions, or agreement reached between Users. All Users expressly agree not to hold Help Around Town liable for any harm or damages relating to use of this site or services requested or performed. Help Around Town expressly disclaims any liability whatsoever for any damage, suits, claims, and/or controversies that have arisen or may arise, whether known or unknown.
By registering as a Buyer of Service Provider, each User certifies that he or she meets and will continue to meet all eligibility requirements for use of this site, including:
- The User is at least 14 years of age.
- If the User is under 18 years of age, that the User's parent or legal guardian is aware of the User's registration and consents to the User's registration and use of the site, and
- The User has not been convicted of any crime, including any felony or misdemeanor of any kind, and has not been convicted of or charged with any sexual offense.
Users are responsible for providing accurate and complete information to Help Around Town in connection with their registration and use of the site. Users understand and agree that Help Around Town does not independently verify User's eligibility. Help Around Town may terminate at any time the registration of any User that Help Around Town, in its discretion, concludes has provided inaccurate or incomplete registration information or who does not meet the eligibility requirements, without notice or refund for any payments made.
Users of this site may enter into agreements between or among themselves. Help Around Town is not a party to any agreement between Users and is not responsible for the content of any agreement. Users must resolve any conflicts or disputes arising out of an agreement for services directly with the other User. Users are responsible for compliance with all applicable laws and regulations, including but not limited to child labor and tax laws. Each User agrees to be the only user of his or her account and assumes full responsibility for any materials uploaded, posted, emailed, or distributed.
Each User agrees that he or she will NOT use the website for any illegal or inappropriate purpose, and affirmatively agrees not to:
- Defame, abuse, harass, stalk, threaten, or otherwise violate the legal rights of others.
- Upload, post, email, distribute, or transmit any material that is unlawful, harmful, abusive, threatening, harassing, tortious, defamatory, offensive, obscene, libelous, discriminatory, infringing, or invasive of another's privacy.
- Harm minors in any way.
- Impersonate another person or entity or allow any other person or entity to use the User's account.
- Upload, post, email, distribute, or transmit any unauthorized material, including advertising, contest or promotional meterials, spam, or any material that contains any viruses or other computer code designed to interrupt, destroy, or limit the functionality of any software or hardware, or intercept or expropriate any data or personal information, or
- Collect, disseminate, or store personal data about other Users for any purpose other than as authorized by this Agreement.
Users agree that it is the sole responsibility of the User to evaluate all material, including the accuracy, completeness, or usefulness of the material. The User bears all risks of relying on any material uploaded, posted, emailed, or distributed, or the representations of any other User. Users agree and are encouraged to make their own decisions and assessments before entering any agreement with another User. Help Around Town has established a rating and comment system to assist Users in deciding whether to enter an agreement with another User, but Users understand and agree that Help Around Town does not control any User ratings and is not responsible for the accuracy or reliability of the information.
Help Around Town Rights
Help Around Town shall have the right, but not the obligation, in its sole discretion to remove any materials or terminate the registration of any User for any reason, without notice. No refund of any payment made will be provided if the User has violated this Agreement in any way. Help Around Town is not responsible for the timeliness, deletion, technical failure, or improper delivery of any material.
Help Around Town provides its services AS IS and may, at any time, modify or discontinue services offered and fees charged without notice or liability.
By submitting materials to Help Around Town, you grant the site a world-wide, royalty-free, and non-exclusive license to sublicense, use, reproduce, modify, adapt, and publicly perform or display the materials and you represent that you have all legal, moral, and other rights necessary to submit the materials and grant these rights.
You agree to indemnify and hold harmless Help Around Town, including all subsidiaries, affiliates, officers, directors, employees, independent contractors, and agents from any claim or demand, including costs or attorney's fees, that may be made by you or a third party, that is due to or arising out of your conduct or connection with this website or service, your provision of materials, your violation of this Agreement or any other violation of the rights of another person or party or any civil or criminal violation.
LIMITATIONS OF LIABILITY AND DISCLAIMER OF WARRANTIES
HELP AROUND TOWN DOES NOT WARRANT THAT THE SITE WILL OPERATE ERROR-FREE OR THAT THE SITE AND ITS SERVERS ARE FREE OF COMPUTER DEFECTS OR OTHER HARMFUL MECHANISMS. IF YOUR USE OF THE SITE OR ITS CONTENT RESULTS IN THE NEED FOR SERVICING OR REPLACING EQUIPMENT OR DATA, HELP AROUND TOWN IS NOT RESPONSIBLE FOR THOSE COSTS.
THE SITE AND CONTENT ARE PROVIDED ON AN "AS IS" BASIS WITHOUT ANY WARRANTIES OF ANY KIND. HELP AROUND TOWN, TO THE FULLEST EXTENT PERMITTED BY LAW, DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE WARRANTY OF MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSE AND NON-INFRINGEMENT. HELP AROUND TOWN MAKES NO WARRANTIES ABOUT THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF THE CONTENT, SERVICES, SOFTWARE, TEXT, GRAPHICS, AND LINKS.
IN NO EVENT SHALL HELP AROUND TOWN, ITS LICENSORS, OR ANY THIRD PARTIES REFERENCED ON THE SITE BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, INCIDENTAL AND CONSEQUENTIAL DAMAGES, LOST PROFITS, OR DAMAGES RESULTING FROM LOST DATA OR BUSINESS INTERRUPTION) RESULTING FROM THE USE OR INABILITY TO USE THE SITE AND ITS CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Help Around Town restricts User registration to persons over the age of 13. Help Around Town will not knowingly collect any information from children under the age of 13. You must identify your age during the registration process. Help Around Town has designed policies and procedures to comply with the Children's Online Privacy Protection Act of 1998 (COPPA) and all Federal Trade Commission (FTC) regulations, but does not assume responsibility for the misrepresentations of any User as to their age.
Help Around Town does not believe that the website contains materials that would typically be the subject of filtering software and the website is not intended for children. Nevertheless and pursuant to the Communications Decency Act (CDA). Help Around Town informs all Users that parental control protections (such as computer hardware, software, and filtering services) are commercially available that may assist in limiting access to material that is harmful to minors. This Agreement and any use of this site or services is governed by and construed according to Massachusetts law, without regard to conflict of laws provisions. By registering or using this site you consent and agree to submit to personal jurisdiction and exclusive venue in the state and federal courts located in Boston, Massachusetts. The failure of Help Around Town to enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. In the event any provision of this Agreement is found to be invalid, void, or illegal, the court will give effect to the parties' intentions to the extent possible and all other terms remain in full force and effect.
Collection and Use of Date
User Registration requires an individual to disclose his or her name, birth date, address, email address, and, if under 18, his or her parent's name and email address. Help Around Town collects this information to make sure that each User meets the website eligibility requirements. This information is used to create accounts, for billing purposes, and, under circumstances detailed below, to share with other Users. Help Around Town does not share your information or engage in cross-marketing or link-referral programs with other sites.
Once a User enters an agreement for services with another User, Help Around Town creates a log with the basic transaction information, including the terms, time, and location of the service. Help Around Town will share this log and other User contact information with the parents or legal guardians of users under the age of 18.
By registering for the site and creating a User profile and postings, you may allow other Users to view your personal information, including any material submitted in a posting or email. Only registered Users may view the contact information of Buyers. Service Provider contact information may be viewed by Buyers only once the User initiates contact with a Buyer, but address information for Users under the age of 16 is never displayed. Contact information and profiles are not searchable by Users or other parties. A User's age is also displayed to other registered Users if the User is under the age of 25, and, if not, the User will be designated as a person age 25 or above.
As with many websites, the site editor may also automatically receive general information contained in log files, such as your IP address and cookie information, which may be user for system administration and to monitor the website. Additionally, Help Around Town may share your information with subcontractors that provide us with services, including but not limited to creating maintaining our website and databases, processing of information, and research, analysis and marketing. Help Around Town may also share your information as required by law, to report any activities we reasonably believe are unlawful to law enforcement or comply with any investigation, or in relation to any lawsuit brough by us or to defend any claims against us.
Age of Users
Persons aged 13 or younger are not allowed to become registrered Users of this website. All persons aged 14-17 must obtain parental consent to become a registered User of the site. Parents of persons age 14 and 15 must affirmatively opt-in to the registration process for their child, while parents of persons aged 16 or 17 may opt their child out of the registration process. Upon notification by a parent or legal guardian that a minor may not use this website, the minor is prevented from attempting to re-register for a period of six months.
Address information for Users under the age of 15 is never displayed.
Help Around Town has put in place reasonable physical, electronic, and managerial procedures to prevent unauthorized access to your information and to maintain the accuracy of the information we collect and store. These policies seek to comply with all state and federal data privacy laws and regulations. While we cannot promise these procedures will be 100% effective, Help Around Town will comply with all laws in notifying you of any data breach of your personal information.
